US Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her order, the court pointed out that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
