The NBA legend Testifies He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.
Financial Stakes and a Competitive Drive
The owner disclosed operational insights of his 23XI team, saying he put in $40m of his own funds into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar as a whole. I felt as far as the sport it needed to be looked at from a different view.”
Central Issue: Franchise System and Contract Pressure
The heart of the case involves the expiration of a 2016 agreement where Nascar granted each team a “charter”. The concept is similar to other major leagues with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded charter membership renewals.
Jordan testified for about sixty minutes and left the court to pandemonium, with onlookers and reporters clamoring for a glimpse or a photo of the sports legend.
Spearheading the Fight
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is unlawful to maintain excessive control.
For Jordan and and Heather Gibbs, who preceded Jordan, are details from September 2024. She recounted a hectic and tense period where the racing circuit told teams they must sign a charter agreement extension. This agreement spanned over a hundred pages detailing team compensation and a guaranteed spot in every race.
A Refusal to Sign
Jordan said that 23XI and Front Row Motorsports concluded their only feasible option was to refuse a signature that 112-page package and take the issue to court. The other 13 organizations signed the agreement.
The team owners reached out to Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.
The Bottom Line: Winning
Ultimately, the pushback against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Winning.
“Denny convinced me getting a third driver boosted our odds of winning,” he said, noting that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I dove in.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.
She said, Joe Gibbs first tried to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
